Referrals Coming into Texas from Other States
ICJ Staff Responsibilities:
- Completes intake on the
initial referral packet.
- Notifies the TJJD Parole
Officer of the referral and forwards to the Parole Officer.
- Places youth information
on ICJ sex offender tracking list.
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Reviews the initial referral
packet and includes the Sex Offender Notification and Registration Requirements
in the home evaluation and recommendation.
If Placement is Approved by
the Texas Deputy Compact Administrator
Initial
Contact and Community Supervision
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Prepares for the arrival
packet (CMS.10.01).
- Completes the CR-32 (dated
9/01) and CR-35 (dated 8/01) forms with the accurate information.
- Separates the white
and yellow copies of the CR-35 form.
- Faxes a copy of the
CR-32 to DPS Special Crimes at (512) 424-7702.
- Sends the white copy
of the CR-35 to Texas DPS, Crime Records, at P.O. Box 4143, Austin,
Texas 78765.
- Sends the original CR-32
and a yellow copy of the CR-35 to local law enforcement in the city/town
where the youth is to live.
- Places copies of the
CR-32 and CR-35 in the youth's ICJ file, which is prepared by the
parole officer.
- Forwards three (3) copies
of the CR-32 and CR-35 to the Texas ICJ office.
- Ensures that youth provides
proof of registration.
- Makes four (4) copies
of the verification of registration.
- Places a copy in the
youth's ICJ file.
- Forwards three (3) copies
to the Texas ICJ Office.
ICJ Staff Responsibilities:
- Verifies that youth is
listed on the DPS Sex Offender Registration Website.
- Forwards two (2) copies
of the CR-32, CR-35 and proof of registration to the sending state's
ICJ Office.
Updates (including address changes)
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Completes a CR-39 Update
form (dated 8/01) when there is any change in the youth's status that
may affect the proper supervision of that youth.
- Places a copy in the
youth's ICJ file.
- Sends the original to
local law enforcement where the youth is currently registered, and
three (3) copies to the Texas ICJ Office.
ICJ Staff Responsibilities:
- Forwards two (2) copies
of the CR-39 to the sending state's ICJ Office with a letter advising
of the change in youth's status.
- Updates the ICJ sex offender
tracking list as applicable.
Annual
Verification Requirement
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Reminds youth of the annual
verification requirement.
- Ensures that the annual
verification requirement is part of youth's ICP. Youth will report to
local law enforcement where he currently resides within 30 days of the
anniversary date of the initial registration, which is the youth's birth
date, and update his registration.
- Forwards three (3) copies
of all ICPs and current registration to the Texas ICJ Office.
ICJ Staff Responsibilities:
- Verifies that youth is
notified of annual verIfication requirement.
- Forwards two (2) copies
of ICPs and current registration to sending state's ICJ Office.
Discharge by the Sending State
ICJ Staff Responsibilities:
- Forwards the discharge
report and Final Notice of Texas Sex Offender Registration Requirements
form to the TJJD Parole Officer when the discharge report is received
from the sending state's ICJ Office.
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Receives the discharge
report and Final Notice of Texas Sex Offender Registration Requirements
form.
- Notifies youth that
this is the final notice he will receive from TJJD regarding his
responsibilities to register as a sex offender.
- Notifies youth that
it is his responsibility to ensure his registration is current and
in compliance with applicable laws.
- Advises youth to comply
with sex offender registration requirements wherever he is to reside.
- Advises youth that
as long as he resides in Texas, he must register in Texas, give
prompt notice to law enforcement of any change of address, job or
other significant circumstances, and verify his registration every
year for ten (10) years from his discharge date.
- Advises youth that failure
to maintain proper registration is a felony for which he may be
sentenced to prison for up to 99 years.
- Advises youth of the
date when his obligation to register as a sex offender in the State
of Texas will be fulfilled.
- Notifies youth that
if he intends to move to another state, he must notify the law enforcement
agency where he is registered.
- Obtains youth's signature
to indicate that he has read or has had this information read to
him and understands the meaning of it and agrees.
- Signs as witness and
dates the form.
- Forwards the original
and three (3) copies to the Texas ICJ Office.
- Gives one (1) copy to
the youth.
- Maintains one (1) copy
for the TJJD Parole Officer ICJ file.
ICJ Staff Responsibilities:
- Complete CR-39 Update form
(dated 8/01) with discharge date and fax to Vincent Castilleja at DPS (512)
424-7702.
- Maintains one (1) copy and
forwards two (2) copies of the completed and signed Final Notice of
Texas Sex Offender Registration form.
- Closes ICJ file and enters
on the system.
- Updates the ICJ sex offender
tracking list.
Return to Sending State or Move to a Third State
Receiving TJJD Parole Officer
(includes Contract Parole) Responsibilities:
- Contacts the Texas ICJ
Office to obtain the law enforcement agency and contact person in the
other state.
- Completes a CR-39 Update
form (dated 8/01).
- Places a copy in the
youth's ICJ file.
- Sends a copy to local
law enforcement where the youth is currently registered.
- Sends three (3) copies
to the Texas ICJ Office.
ICJ Staff Responsibilities:
- Verifies with the sending
state if the move is approved. If the move is approved, the Texas ICJ
Office receives reporting instructions and other requirements. The Texas
ICJ Office provides the TJJD Parole Officer with this information and
the registering agency and contact person in the other state.
- Faxes the notification to
the other state's registering agency.
- Verifies receipt of the
notification.
- Updates the ICJ sex offender
tracking list.
- Closes ICJ file and updates
system.
