Sending Staff (PSW) Responsibilities:

Sends a completed CR-39,
Update form (dated 8/01), a copy of the current CR-35 Registration
form, and a copy of the current verification of registration to
the Texas ICJ office with the initial ICJ referral packet in addition
to the already required ICJ referral information, refer to CMS.10.01.
Note:
When sending a youth to another state, you will use only one
law enforcement agency and contact person per state. To determine
each state's registering law enforcement agency, call ICJ Staff at (512) 406-7755

Makes three
(3) copies of the CR-39. |

Places one
(1) copy in the Sex Offender Registration section of the youth's masterfile,
and |

(c) |
Retains
the other two (2) copies in the masterfile until the home evaluation
is received from the Texas ICJ Office. (These are to be forwarded
to local law enforcement and Texas DPS if the home is approved.) |
ICJ Staff Responsibilities:
- Verifies that the CR-39
is received with ICJ referral.
- Verifies that a copy of
the current CR-35 is received with ICJ referral.
- Verifies that a copy of
the current verification of registration form is received with the ICJ
referral.
- Places youth information
on the ICJ sex offender tracking list.
- Forwards the referral and
sex offender registrations forms to the receiving state for a home evaluation.
If
Placement in the Receiving State is Approved
Sending Staff (PSW) Responsibilities:
- Forwards a copy of the
CR-39 (dated 8/01) to local law enforcement where the youth is currently
registered.
- Forwards the arrival packets
to the Texas ICJ Office (see CMS.10.01)
and advises that copies of the CR-39 have been sent to local law enforcement
.
- Creates a 'NEW' 547 and
enters the information on the local law enforcement agency in the other
state on the 'TOP' portion of the 547.
- Completes the 118.
ICJ Staff Responsibilities:
- Verifies that PSW has provided
written documentation that the CR-39 Update form has been forwarded
to local law enforcement and Texas DPS.
- Forwards the CR-39 to the
receiving state's sex offender registering agency when the arrival packet
is received with the arrival date.
- Verifies receipt of the
notification with the receiving state's sex offender registering agency.
Note: Some states require
registration for juvenile sex offenders, some states allow for juvenile
registration if it is required in the sending states, while others do
not require any type of registration. Regardless of a receiving state's
requirements, under Texas law, we are required to notify the registering
agencies when we are releasing a juvenile sex offender into the community.
The ICJ Office provides the proper notification to the registering authority
in the receiving state.
- Forwards the arrival packets
to the other state's ICJ Office with notice that their state's registering
authority has been notified of this offender's release into their community.
